Monitoring Fundamental Rights at the Border – A Guide on National Independent Mechanisms 

As part of the new Pact on Migration and Asylum, all EU Member States will be required, from mid-2026, to establish an independent mechanism to monitor compliance with fundamental rights during screening procedures and border asylum processes. This guide, published by the European Union Agency for Fundamental Rights (FRA) in 2024, offers practical guidance for setting up and operating such mechanisms. It provides non-binding but detailed recommendations based on the legal obligations set out in the relevant EU regulations, as well as international standards and best practices, and serves as a key tool for ensuring transparency, accountability, and the protection of fundamental rights at the border.
