Final recommendations of the Centre for Peace Studies and the Human Rights House Zagreb for the execution of the judgment of M.H. and Others against Croatia

Nearly seven years ago, six-year-old Madina Hussiny tragically lost her life, and justice for her death remains elusive. Despite a clear judgment by the European Court of Human Rights (ECtHR), Croatia has failed to adequately respond to the requirements for an investigation into responsibility and compensation for the Hussiny family. The Centre for Peace Studies and the Human Rights House Zagreb have alerted the Committee of Ministers of the Council of Europe to Croatia’s serious shortcomings in executing the judgment.

Even in the reopened procedure, the Office for the Suppression of Corruption and Organised Crime (USKOK) did not conduct a thorough investigation to identify those responsible for the death of young Madina, despite clear recommendations from the family’s legal representatives, the Ombudswoman, and civil society organisations. USKOK repeated the same failures as before and dismissed the criminal complaint, thus disregarding the binding judgment of the ECtHR.

With this third submission, we call on the Government to adopt a concrete action plan that includes an effective investigation, accountability for those responsible, and compensation for the family. We also demand systemic changes to end unlawful expulsions, ensure accountability, and secure effective oversight of police conduct and respect for the rule of law in Croatia.
